By accessing or using this mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

3. Description of Service

Daily Ayurveda is a wellness application providing:

• Traditional Ayurvedic wellness information
• Seasonal lifestyle guidance (Ritucharya)
• Constitutional assessment tools (Prakriti/Vikriti)
• Personalized wellness practice recommendations
• Educational content about doshas and wellness practices
• Doctor consultations with qualified Ayurvedic practitioners via video or phone call

3.1 Personalization Levels

The App offers two levels of wellness guidance:

• Season-based recommendations: Available to all users, including those who have not completed assessments. These recommendations are based on the current Ayurvedic season (Ritu) and are general in nature.
• Personalized recommendations: Available after completing the Prakriti (constitution) and/or Vikriti (current health) assessments. These recommendations are filtered and scored based on your individual constitution and health status.

Completing the Prakriti and Vikriti assessments is strongly recommended but not mandatory. Users who choose to use the App without completing assessments acknowledge that their recommendations are not personalized to their individual constitution and may not account for dosha-specific sensitivities or contraindications.

4. Doctor Consultation Service

4.1 Nature of Service

Daily Ayurveda offers online consultations with qualified Ayurvedic practitioners registered with the relevant State Medical Council under the AYUSH system. Consultations are conducted via video call or phone call as selected by the user during booking.

4.2 Scope and Limitations

Doctor consultations through this App are intended for:

• General Ayurvedic wellness guidance
• Minor, temporary health concerns (mild digestive discomfort, occasional sleep issues, minor skin irritations, temporary low energy, mild stress)
• Guidance on Ayurvedic diet, lifestyle, and herbal preparations
• Follow-up on wellness plans and progress

Consultations are NOT suitable for:

• Medical emergencies or conditions requiring immediate attention
• Chronic conditions lasting more than 4 weeks without prior medical evaluation
• Diagnosis or treatment of serious diseases
• Replacement for treatment by your primary care physician
• Prescribing or modifying allopathic medication

4.3 Practitioner Qualifications

All practitioners on Daily Ayurveda hold a minimum qualification of BAMS (Bachelor of Ayurveda, Medicine and Surgery) and are registered with their respective State Medical Council. Practitioner credentials, including registration numbers, are displayed within the App and on prescriptions.

4.4 Telemedicine Compliance

Our consultation services comply with the Telemedicine Practice Guidelines 2020 issued by the Board of Governors in supersession of the Medical Council of India, and applicable AYUSH telemedicine regulations. By booking a consultation, you acknowledge that:

• Telemedicine has inherent limitations compared to in-person consultations
• The practitioner may recommend an in-person visit if the concern cannot be adequately addressed remotely
• Your explicit informed consent is recorded for each consultation
• Consultation records are maintained as required by applicable medical record-keeping regulations

4.5 Consultation Fees and Payment

• Consultation fees are displayed before booking and must be paid in full at the time of booking
• Payments are processed securely through our payment gateway partner (Cashfree Payments)
• Fees include one free follow-up consultation within 7 days of the original consultation
• For cancellation and rescheduling terms, please refer to our Refund & Cancellation Policy

4.6 Your Responsibilities

When using the consultation service, you agree to:

• Provide accurate and complete health information
• Be available at the scheduled consultation time
• Ensure adequate connectivity for video or phone calls
• Follow up with a qualified physician for any condition that worsens or does not improve
• Not rely solely on online consultation for conditions requiring physical examination

5. Health Disclaimer & Limitations

5.1 Educational Purpose Only

5.2 Doctor Consultations

While our App offers consultations with qualified Ayurvedic practitioners, these consultations are for general wellness guidance only. They do not constitute a comprehensive medical examination and have inherent limitations compared to in-person consultations. The consulting practitioner may recommend an in-person visit when appropriate.

5.3 No Doctor-Patient Relationship

Use of the wellness features of this App does not create a doctor-patient relationship between you and MPower Digital. A practitioner-patient relationship exists only during and in relation to a booked consultation with a specific practitioner, and is governed by applicable medical ethics and regulations.

5.4 Medical Consultation Required

ALWAYS consult qualified healthcare professionals before:

• Starting any new wellness practices
• Making changes to your diet or lifestyle
• Discontinuing prescribed medications
• If you have existing medical conditions
• For any health concerns or symptoms

5.5 Non-Personalized Recommendations

If you choose to use the App without completing the Prakriti and/or Vikriti assessments:

• Wellness practices are recommended based on seasonal suitability only and are not filtered for your individual constitution (Prakriti) or current health concerns (Vikriti)
• Certain practices that are generally beneficial for the current season may still be contraindicated for your specific body type or health condition
• You assume full responsibility for selecting and following practices without personalized guidance
• We strongly recommend completing both assessments at the earliest opportunity to receive recommendations suited to your individual needs

6. User Eligibility

General App Usage (Wellness Features)

• This App's wellness content, assessments, and lifestyle recommendations are designed primarily for adults
• Users aged 16 and above may use these features independently
• Users below 16 may use the App under direct supervision of a parent or legal guardian
• If you are using this App on behalf of another person (such as helping a family member), ensure you have their consent and input accurate information about them

Paid Services (Consultations & Purchases)

• Paid services, including telemedicine consultations, require users to be at least 18 years old OR have verifiable parental/guardian consent
• Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 (including minors for paid services and undischarged insolvents) must have a parent or legal guardian complete the transaction on their behalf
• We reserve the right to refuse service or terminate accounts if age or eligibility misrepresentation is discovered

Health Assessments

• The Prakriti and Vikriti assessments are recommended for all users but are optional
• The Prakriti and Vikriti assessments should reflect the health information of the person for whom the profile is created
• Providing inaccurate information may result in unsuitable recommendations
• Choosing not to complete assessments means recommendations will not be personalized to your constitution or current health status, and may include practices that are not ideally suited to your body type
• You may complete assessments at any time after creating your account to activate personalized recommendations

7. Prohibited Uses

You agree NOT to:

• Use the App for medical emergencies
• Rely solely on App content for health decisions
• Share your account credentials
• Reverse engineer or copy the App
• Use the App for any illegal purposes
• Misrepresent information in assessments

8. Intellectual Property

• All content, including text, graphics, logos, and software, is owned by MPower Digital or its licensors
• Traditional Ayurvedic knowledge is in public domain; our presentation and algorithms are proprietary
• You may not reproduce, distribute, or create derivative works

9. User-Generated Content

• You retain ownership of content you provide
• You grant us license to use your content for service provision
• You represent that your content is accurate and lawful

10. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which governs collection and use of your information.

11. Limitation of Liability

To the maximum extent permitted by Indian law:

• MPower Digital provides the App "AS IS" without warranties
• We disclaim all liability for health outcomes
• We are not liable for decisions made based on App content
• Total liability shall not exceed the amount paid by you (if any)

We do not warrant that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is free of viruses or harmful components

12. Indemnification

You agree to indemnify and hold harmless MPower Digital from any claims arising from your use of the App or violation of these Terms.

13. Termination

• You may terminate your account at any time
• We may suspend/terminate your access for Terms violations
• Termination doesn't affect accrued rights or obligations

14. Governing Law and Jurisdiction

• These Terms are governed by Indian law
• Disputes shall be subject to exclusive jurisdiction of courts in Bangalore, Karnataka
• Any disputes will first be attempted to be resolved through mediation

15. Changes to Terms

We may modify these Terms at any time. Continued use constitutes acceptance of modified Terms. Material changes will be notified through the App.

16. Severability

If any provision is deemed invalid, the remaining provisions remain in effect.
